Before an employer or buyer cancels a service or project, we recommend them to communicate with the seller or freelancer and express their concerns to let him/her address them. Alternatively, you can connect with the customer support to help them resolve your issues efficiently. Most issues can be sorted out efficiently with simple communication and sellers or freelancers on Uepaki.com care about keeping their clients happy. If the buyer or employer is not able to communicate with the seller or freelancer and feels that the seller or freelancer is not adhering to the rules of engagement then the buyer or employer can raise his/her concerns before Uepaki.com for assistance to get the service or project back on track.

After allotment of the said project & before the commencement of a service or project, the buyer or seller may request a cancellation:

  • Either party must notify the other party of the cancellation by placing a message in the chat column. The addressing party should even be intimating the customer support about the default, if in case the addressing party doesn’t receive any response from the other party or in case if the allotted project was done by mistake. Alternatively, if there are funds in the Safe Deposit Account (Escrow Account and the buyer or employer believes that they are entitled for a refund (subject to Section 1.2), the buyer or employer can notify the customer support of the cancellation by requesting a refund to the customer support.
  • If the buyer or employer fails to notify the seller or freelancer within 12 hours of allotment of project or after the payment of the previous milestone has been transferred to the seller or freelancer account, that he wishes to cancel the project and the project gets subsequently initiated or completed, the buyer or employer must pay for the service delivered in accordance with these terms and conditions.

Once notified of a cancellation:

  • The freelancer or seller is free to stop working on the service or the project anytime;
  • The parties should agree in the specified chat column what payment is necessary for any work completed (or time spent, if it is a per hour custom project). If the cause of the cancellation was not due to the circumstances defined in Section 1.2 the seller or employer is entitled to request payment at minimum equal to the value of the deposit funds held in the Safe Deposit Account (Escrow Account).

A Buyer is entitled to receive a refund of funds held in the Safe Deposit Account under the following circumstances.

  • No response: If the seller or freelancer has not responded to buyer or employer within 1 day of proposal acceptance by the buyer or employer;
  • Non-delivery:
    • For Services, if the seller or freelancer did not deliver the scope of work within the delivery timescale defined over the milestones or the service agreement or as agreed with the buyer or employer within the scope of Uepaki.com platform. For fixed price or price per item custom projects, non-delivery means agreed scope of work was not delivered within the agreed timescale;
    • For per hour rate custom projects no time will be considered as an input from the freelancer or seller side.
  • Poor quality: With the exception of per hour rate custom projects, the deliverables provided by the seller do not meet the terms defined after at least two revisions have been provided by the seller or freelancer in response to detailed feedback from the buyer or employer; or
  • The seller or freelancer lost a dispute:
    • Buyer or Employer and Seller or Freelancer may mutually agree to a refund for reasons other than the previous clause however authorization of such refunds will be subject to a review by Uepaki.com team, as defined in Section 1.3
    • Refunds are only applicable to funds held in the Safe Deposit Account. Funds should only be paid out of the Safe Deposit Account once the buyer has confirmed satisfaction with the quality of the service or project (or any agreed milestone deliverables) has been completed. By releasing funds from the Safe Deposit Account, the Buyer accepts that this money is non-refundable.
    • Buyers or Employers should NEVER file a dispute or reverse a payment through their Credit Card Company or Bank. Attempts to seek refunds in this way will lead to the Buyer's account being permanently suspended and may attract legal actions.

A Buyer or employer can request a refund of the funds held in the Safe Deposit Account by raising a request with the customer support detailing out the reason for the request:

  • The Seller must either approve or reject the refund request. Rejected refund requests will be raised automatically before Uepaki.com for dispute assistance.
  • If the seller or freelancer does not respond to the refund request within three (3) working days (a “non-Actioned” refund request) then UEPAKI.COM may release the funds automatically back to the buyer Uepaki Wallet and if no such explanation will be provided by sellers within 7 days, amount will be credited back to the customer account.
  • Poor quality: with the exception of per hour rate custom projects, the deliverables provided by the seller or freelancer do not meet the terms defined after at least two revisions have been provided by the seller in response to detailed feedback from the buyer; or
  • The Seller lost a Dispute.

UEPAKI.COMwill process approved (or non-actioned) refund requests back to the buyer's Uepaki.com wallet subject to a review of the refund reason and circumstances to ensure that both parties have complied with these terms and conditions, and that the purpose of the refund is not to avoid any of the parties' obligations under these terms and conditions. If Uepaki.com reasonably believes that the parties have not complied with these terms and conditions or are seeking to avoid any such obligations Uepaki.com shall not be obliged to make the refund.

Users are strictly discouraged from causing cancellations and refunds. Refunds will impact users standing in the Uepaki.com marketplace as follows:

  • Where the seller is at fault for the refund (for example, due to no response, poor quality of work or they have cancelled the project), it will negatively impact their seller status and rankings;
  • Where the buyer is found to be the cause for the refund (for example, an early cancellation due to a change in their business need) it will negatively impact their buyer status;
  • Multiple refunds attributed to a user will lead to temporary and/ or permanent restrictions on their account depending upon the severity.

UEPAKI.COM will process approved (or non-actioned) refund requests back to the Buyer's UEPAKI.COM Wallet subject to a review of the refund reason and circumstances to ensure that both parties have complied with these terms and conditions, and that the purpose of the refund is not to avoid any of the parties' obligations under these terms and conditions. If UEPAKI.COM reasonably believes that the parties have not complied with these terms and conditions or are seeking to avoid any such obligations UEPAKI.COM shall not be obliged to make the refund.

  • A chargeback (being a challenge to a payment that a buyer files directly with their credit card issuer) and a reversal instruction is made by the payment product issuer or third parties (such as payment processors) and not by us. We are bound to follow their instructions.
  • You acknowledge and agree that we will be entitled to recover chargebacks and reversals that may be imposed on us by a payment product issuer or third parties (such as payment processors) on funds paid to you by buyers through the website.
  • You agree that we may reverse any such payments made to you, which are subject to chargeback or reversal instruction via your payment product issuer or third parties (such as payment processors).

Sellers or Freelancers at Uepaki.com have been given a medium to understand customer’s needs and wants in a better way. However, freelancers or sellers are strictly prohibited to exchange their personal information such as email id’s, contact numbers or any social communication links resulting in direct communication with buyers for any pre-sale, order, payments, shipping, post-sale or returns related matters. Sellers or Freelancers are also not allowed to engage in direct or indirect marketing, transferring service or project over other channels, with buyers on Uepaki.com. For specific product inquiries, warranties, shipping or delivery etc., sellers or customers can connect with customer support.

UEPAKI is committed to protecting the intellectual property rights of third parties and to providing a safe marketplace to trade. Unauthorized use or infringement of copyrighted material and trademarks are strictly prohibited at UEPAKI.com.


We at Uepaki has zero tolerance for any intellectual property violations. Counterfeits, unauthorized replicas, unauthorized items (such as counterfeit clothing, handbags, designs, prototypes or other accessories) or unauthorized copies (such as designs, prototypes or photographs, graphic, web and architecture layouts) are not permitted at UEPAKI.com. Unauthorized copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged.


If the product(s) or design(s) you are selling on the marketplace belongs to any other seller or freelancer listed on or out of the marketplace and you are allegedly trying to represent another entity designs and branding, which you haven’t made or designed and doesn’t carry any accessible rights , then don't list it at UEPAKI.com.

Keyword spamming occurs when sellers or freelancers place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing. Keyword spamming in listings is not permitted on UEPAKI.COM. The text sellers place in listings must be directly relevant to the item being sold.


Keyword Abuse/h3>

Keywords that are not shown to the customer on Uepaki.com, mobile web and app versions but are used to return results of listings when searched. Keyword abuse is the practice of including brand names or other in appropriate information in ‘keywords’ attribute. For example, using popular brands like ‘FastTrack’, ‘Titan’, etc. While listing fashion & interior designs, prototypes and the layouts, if the claimed designs does not belong to the mentioned brand.


Brand Name and logo abuse

Including brand name or company logo in seller listing other than the specific brand name used by the company that has manufactured the listing is not allowed. Certain uses of brand names may constitute trademark infringement and could expose seller to legal liability. Sellers are even not permitted to represent any third party or use third-party company logos even if they have the license or permission to use such logos. Such properties can’t be used on Uepaki.com since the marketplace only allow freelancers or sellers that represent independent entities, being themselves the sole owner of the entity and doesn’t allow third party interventions on the platform.


Catalogue attributes abuse

Catalogue attribute abuse is the practice of including misleading information in order to catch attention of customers. This not only results in wrong search results but also provides wrong information to customers

This UEPAKI.COM.COM Membership Agreement (“Agreement”) is part of and incorporates by reference the User Agreement and the other Terms of Service. Your continued use of the Site after the last modified date will signify your acceptance of this Agreement. Capitalized terms not defined in this Agreement are defined in the User Agreement, elsewhere in the Terms of Service, or have the meanings given such terms on the Site.


UEPAKI MEMBERSHIP PROGRAMS

UEPAKI.COM offers several membership programs for UEPAKI.COMs and Companies. For purposes of this Agreement, “Member” or “you” means a UEPAKI.COM or seller/freelancer/company participating in a membership program.

UEPAKI.COM reserves the right to change membership fees or institute new fees at any time, upon reasonable notice posted in advance on the Site. No refunds of fees already paid will be given. If UEPAKI.COM exercises its right to cancel a membership, UEPAKI.COM will not refund the membership fee already paid.


AUTOMATIC MEMBERSHIP RENEWAL

You must pay your UEPAKI.COM membership fees through your UEPAKI.COM account or in other words your seller dashboard. The membership billing period begins on the date that UEPAKI.COM receives payment. UEPAKI.COM membership fees are calculated from the beginning of that billing period. UEPAKI.COM automatically renews your UEPAKI.COM monthly membership, and you irrevocably authorize and instruct UEPAKI.COM to make the required monthly payments to UEPAKI.COM on your behalf as described in the User Agreement. Automatic renewal occurs on the first day after the expiration date.

CHANGES TO MEMBERSHIP PROGRAM

If UEPAKI.COM after the end of each competition cycle found you eligible to get promoted or demoted as per your performance over the marketplace. Your this action can even result into getting changed your membership category and the associated fees, the new program and, new billing period will then be based upon the date UEPAKI.COM receives payment of the new membership fee. If you are promoted to higher category your membership will be upgraded accordingly, it will result in a new billing date effective upon the date of payment of the additional fees and, if applicable, will result in a credit of the unused portion of the existing category membership fees. If you don’t feel like moving in any case to upper category you can discontinue a membership plan by contacting customer support, the same doesn’t apply in case you are eligible to get demoted, also you will not receive a refund or credit for the fees already paid. The discontinue will go into effect at the beginning of the next billing period. UEPAKI.COM reserves the right to modify its membership programs at any time, upon a reasonable notice posted in advance on the Site. UEPAKI.COM on the end of each competition cycle has the right to charge you as per the membership "fees & charges" defined on the website, which applies in both the conditions if UEPAKI.COM promote or demote you, as per your performance in any competition cycle.

Please note the trust you build with your buyers will go away if you artificially start showing higher MRP, so that the selling price appears to be much better deal vs. what it actually is. Artificially increasing MRP is strictly prohibited at UEPAKI.com and any violation will result into account suspension.

Please note that trust is the most important aspect of trade between buyers and sellers in marketplace and one of the key aspects of trust is fair pricing. For healthy transaction flow at UEPAKI.com, we ask you to price your items responsibly. Please note that we are constantly monitoring prices for each seller and freelancer at various channels and do not allow you to price your items at higher prices at UEPAKI.com vs. other channels such as your own retail store, your own website (if any) or any other 3rd party retail stores or websites. You should price your items sold at UEPAKI.com to be same as the lowest rate you are selling at elsewhere or even lower but it should not be more. Violation of our pricing policy will result into warning notices and can also result into account suspension and/or store suspension.

PROHIBITED AND RESTRICTED ITEM POLICY

Following items are not allowed to be sold/displayed online at UEPAKI.com. Please note that Designers/sellers are responsible for any legal issues and other liabilities arising if you try and sell these below mentioned items at UEPAKI.com. We will cancel the listing(s) of prohibited and restricted items within 24 hours after we come to know about such occurrence.


  • Adult Material which includes pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services
  • Alcohol including alcoholic beverages such as beer, liquor, wine or champagne)
  • Animals and Wildlife Products - examples include live animals, mounted specimens, and ivory
  • Artifacts prohibited for sale
  • Beta Software
  • Bootleg/Pirated Recordings
  • Brand Name Misuse
  • Bulk marketing tools which include email lists, software, or other products enabling unsolicited email messages (spam)
  • Cable descramblers and black boxes which includes devices intended to obtain cable and satellite signals for free
  • Catalogue and URL Sales
  • Child pornography which includes pornographic materials involving minors
  • Copies of unauthorized Copyrighted materials whether in electronic or physical form or any other medium which may not be in existence at present

  • Drugs and drug paraphernalia which includes illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms
